Agreement to Terms

These Terms of Service govern your access to and use of the AQUAV website, quote forms, communications, samples, mockups, production services, custom branded bottled water services, and related offerings.

By using our website, requesting a quote, approving a mockup, placing an order, or working with AQUAV, you agree to these Terms.

Services

AQUAV provides custom branded bottled water services, which may include design coordination, product sourcing, label or packaging coordination, mockups, sample coordination, production coordination, delivery coordination, and reorder support.

Product availability, bottle styles, water types, pricing, minimum quantities, timelines, delivery options, and production requirements may change based on supplier availability, production capacity, customer specifications, and market conditions.

Quotes and Pricing

All quotes, estimates, proposals, and pricing are non-binding until confirmed in writing by AQUAV. Pricing may vary based on bottle type, size, water type, quantity, artwork requirements, setup fees, delivery location, supplier pricing, taxes, rush timelines, and other order-specific factors.

Orders and Payment

An order is not final until AQUAV confirms it in writing and any required deposit, prepayment, signed approval, or purchase authorization has been received. New customers may be required to pay in full before production begins.

Artwork, Logos, and Customer Materials

You are responsible for providing accurate, high-quality, and legally authorized logos, artwork, names, trademarks, designs, images, copy, and brand assets. By submitting materials to AQUAV, you represent and warrant that you own or have permission to use them and that their use will not violate any third-party rights.

You authorize AQUAV and its vendors, designers, printers, manufacturers, and service providers to use your submitted materials as needed to prepare quotes, mockups, proofs, samples, production files, and completed orders.

Proofs, Mockups, and Approvals

Digital mockups and proofs are for general layout and visual reference only. Colors, sizing, placement, bottle shape, material appearance, print finish, label finish, and final product appearance may vary from screen previews, mockups, samples, or prior production runs.

You are responsible for reviewing all proofs carefully before approval. Once approved, production errors resulting from approved artwork or customer-provided information are the customer’s responsibility.

Production and Delivery

Production and delivery timelines are estimates only and are not guaranteed unless expressly stated in writing. Delays may occur due to supplier issues, artwork delays, payment delays, product availability, shipping delays, carrier delays, weather, labor issues, equipment issues, or other circumstances outside AQUAV’s control.

Changes, Cancellations, and Reorders

Order changes or cancellations are not guaranteed once artwork, setup, procurement, production, or scheduling has begun. Reorders may be faster when artwork and specifications remain unchanged, but pricing, availability, minimums, and timelines may still change.

Returns and Refunds

Because custom branded products are made specifically for each customer, orders are generally non-returnable and non-refundable once approved or produced, unless AQUAV determines there was a production error not caused by customer-provided artwork, approved proofs, inaccurate information, or customer changes.

Intellectual Property

The AQUAV name, logo, website, designs, copy, layout, concepts, mockup formats, and related brand materials are owned by AQUAV or its licensors and may not be copied, reproduced, or used without written permission.

Limitation of Liability

To the fullest extent permitted by law, AQUAV will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. AQUAV’s total liability for any claim will not exceed the amount paid by the customer for the specific order giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless AQUAV, its owners, employees, contractors, vendors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising out of your submitted materials, trademark or copyright issues, misuse of products, breach of these Terms, violation of law, or inaccurate information you provide.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
